Welcome to the DMCA page of 3ace Media, where we are committed to protecting the rights of copyright owners while promoting a creative and innovative online community. On this page, we’ll explain what the Digital Millennium Copyright Act (DMCA) is, how it works, and what you should do if you believe that your copyrighted material has been infringed.
The DMCA is a federal law that provides a process for copyright owners to notify online service providers of copyright infringement. The law requires service providers, like 3ace Media, to promptly remove or disable access to infringing material upon receipt of proper notification from a copyright owner or their agent.
If you are a copyright owner or an authorized agent and believe that your copyrighted material has been infringed on our website, you may submit a notice of claimed infringement (NOCI) to our designated agent for DMCA notices. To be effective, your NOCI must include:
- A physical or electronic signature of the copyright owner or authorized agent
- Identification of the copyrighted work that has been infringed
- Identification of the infringing material, including its location on our website
- Your contact information, including your name, address, phone number, and email address
- A statement that you have a good faith belief that the use of the copyrighted material is not authorized by the copyright owner, its agent, or the law
- A statement that the information in the NOCI is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner
Upon receipt of a proper NOCI, we will promptly remove or disable access to the allegedly infringing material and notify the user who posted the material. We may also terminate the user’s account in certain circumstances.
If you believe that your material was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notification to our designated agent. To be effective, your counter-notification must include:
- A physical or electronic signature
- Identification of the material that was removed or disabled and its location on our website
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification
- Your contact information, including your name, address, phone number, and email address
- A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside the United States, for any judicial district in which we may be found
- A statement that you will accept service of process from the person who provided the NOCI or their agent
Upon receipt of a proper counter-notification, we will promptly provide the party who provided the NOCI with a copy of your counter-notification and inform them that we will replace the removed material or cease disabling access to it in 10 business days. If the party who provided the NOCI does not file a court action seeking a court order to restrain you from engaging in infringing activity related to the removed or disabled material within 10 business days, we will replace or restore access to the removed material.
